Synopsis
The Insurance Fraud Bureau has reported that fraudulent organised motor insurance claims cost the UK almost £400 million a year. In an effort to tackle the problem, in 2014 the Government introduced a package of measures to drive out dishonest whiplash claims. The reforms are intended to bring down the amount being paid out unnecessarily by insurance companies for fraudulent claims, and enable them to pass on savings to honest customers.

In this programme we consider:

• Qualified one-way costs shifting where a claimant is ‘fundamentally dishonest’
• Case law on the meaning of ‘fundamental dishonesty’
• Legislative changes dealing with fundamental dishonesty
• New rules relating to expert reports and the MedCo IT system
